Privacy Policy

Introduction

We recognize that you value, and Omeros strives to respect, your privacy. This Privacy Policy describes the information we may collect about you, how we use the information, and how we store it. This Privacy Policy governs the use of information collected at and submitted to Omeros' web site and is part of our Terms of Use.

This Privacy Policy applies only to information collected by this site. Other activities or interactions with Omeros may be governed by different privacy terms.

Types of Information Collected and How We Use It

Involuntarily-Collected, Non-Personally Identifiable Information.

Visitors to this site can access the home page and browse this site without disclosing personally identifiable information, such as name, address, email address, and/or phone number. However, we do automatically track information provided to us by your browser, including the web site you came from, the type of browser you use, the time and date of access, and other information that does not personally identify you. We also gather limited information about you that is automatically collected by our web server, such as your IP address and domain name. These types of automatically collected information form log files.

The use of advertising cookies sent by third-party servers is also common in the Internet industry. Cookies contain certain information that a site can then use to make communication between your browser and this site more efficient, such as by tracking site navigation and personal preferences involving dynamic site content. Omeros has no control over and cannot protect against the practices or policies of other web sites that you may link to from this site. You can control whether to allow your browser to accept cookies and configure your browser accordingly. If you choose not to allow cookies this may affect your ability to navigate from this site.

Voluntarily Submitted, Personally Identifiable Information

If you submit personally identifiable information (such as name, address, email address, and/or phone number) to us via an email from this site, we will use your personally identifiable information solely for the intended purpose for which it was submitted, such as in responding to a question that you have submitted, except as otherwise set forth below. We do not share your personally identifiable information with others for their direct marketing purposes. We may, however, share your personally identifiable information with our contractors, agents, or business partners so that they may perform services for us. We require all such companies doing work for Omeros to comply with corresponding applicable provisions of this Privacy Policy, and we use reasonable efforts to limit their use of personally identifiable information. We may also provide your personally identifiable information to third parties with your consent.

In certain limited circumstances, we may be called upon to release your personally identifiable information in response to a court order, subpoena, search warrant, or to comply with state or federal law or regulations. We plan to cooperate with such requests. We also reserve the right to cooperate with law enforcement authorities (or others) in investigating and prosecuting users who violate our Terms of Use or who engage in behavior that is illegal or harmful to other site users, which may also require disclosing your personally identifiable information.

If you contact Omeros regarding your experience with one of our products, we may use the information you provide (whether or not it includes personally identifiable information) in submitting reports to regulatory agencies, such as the U.S. Food and Drug Administration, and as otherwise required of us by law. We also may use the information to contact the prescribing physician to follow up regarding an event involving the use of our product.

In addition, we may conduct research on users' demographics, interests, and behavior based upon information you provide during use of our site. We may combine your information with information collected from other individuals to produce anonymous, aggregated statistical information that will not include personally identifiable information. We may use this aggregated information for our business purposes. We may also share this anonymous, aggregated information with third parties doing work for Omeros.

Storage of Personally Identifiable Information

Email that you send and personally identifiable information included in that email is stored on our mail servers. Omeros uses physical, managerial and other technical measures to ensure we use your information consistently with this policy.

No data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk. Once we receive your transmission, we make reasonable efforts to ensure security on our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of any of our physical, technical or managerial safeguards.

If Omeros learns of a security systems breach we may attempt to notify you electronically so that you can take appropriate protective steps. By using this site or providing personally identifiable information to us you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of this site. Omeros may post a notice on our web site if a security breach occurs. If this happens, you will need a web browser enabling you to view the omeros.com web site. Omeros may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive free written notice of a security breach (or to withdraw your consent from receiving electronic notice) you should notify us at terms@omeros.com.

Once you have sent an email that includes personally identifiable information to Omeros, we will store until deleted and maintain the personally identifiable information you have volunteered in accordance with our internal policies, so long as (1) you have not directed us to delete it, or (2) we are not required by law or court order to store the information for a longer period of time. Of course, you can always contact us via an email from this website in order to (1) remove the personally identifiable information that you have provided to us from our systems or (2) update the personally identifiable information that you have provided to us. We will comply with such requests for deletion of your personally identifiable information from our actively used databases as long as there is no law, regulation or court order that requires us to do otherwise or if in our sole judgment doing so would jeopardize Omeros' rights or the rights of others.

Visitors should be aware that it is not technologically possible to remove from servers each and every record of the information you have provided to Omeros. The need to back up our systems to protect information from inadvertent loss means that a copy of your personally identifiable information may exist in a non-erasable form or in form that will be difficult to completely erase. We will use reasonable efforts, upon receiving your request, to delete your personally identifiable information either stored in the databases that we actively use for research and daily business activities or stored in other readily searchable media. In addition, we will use reasonable efforts not to disclose your personally identifiable information stored in a non-erasable format after receiving your request for removal, except as required by law or court order.

Children's Policy

We are committed to protecting the privacy of children. This site is not directed at children under the age of 13. If we learn that a child under 13 has provided personally identifiable information on this site without their parent or guardian's consent, we will delete such information from our active databases in accordance with the policies described in the Storage of Personally Identifiable Information section above.

Links to Third Party Web Sites

This site may contain links to products, services, and websites not operated by us. We are not responsible for the privacy practices or the content of these products, services, and websites. Please review the privacy policies for these products, services, and websites in order to understand the applicable privacy and information collection practices.

International Transfers

Information that we collect may be stored and processed in the United States or in another country in which we, our agents, or our affiliated businesses maintain operations. By using our products, services, and this site, you consent to any such transfer of information outside of your country.

Merger, Sale or Bankruptcy

In the event that Omeros is acquired by or merged with a third party, we reserve the right, in any of these circumstances, to sell or otherwise transfer the information we have collected as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personally identifiable information is treated, transferred, or used. Therefore, you should know that in such event, your personally identifiable information may be treated like any other Omeros asset, and sold, transferred or shared with third parties, or used in ways not contemplated or permitted hereunder, without notice to you or your consent.

No Error-Free Performance

We do not guarantee error-free performance under this Privacy Policy. We may not always catch an unintended privacy issue, despite our efforts to do so. Accordingly, we welcome your feedback regarding any privacy concerns that you may have, including how we can improve this Privacy Policy. We will use reasonable efforts to comply with this Privacy Policy and will take prompt corrective action when we learn of any failure to comply with it.

Your Consent

By using our site, you consent to the collection and use of information as set forth in this Privacy Policy. You also acknowledge our right to change this policy, without prior notification, and our commitment to post any such changes on this page so that you are fully informed of the types of information we collect, how we use it, and under what circumstances, if any, it is disclosed.

Changes to Our Privacy Policy

This Privacy Policy may be revised periodically. We recommend that you read our Privacy Policy whenever you visit this site so that you are aware of any changes. In general, we will only use your personally identifiable information in the manner described in the Privacy Policy in effect when we received the personally identifiable information you provided. If we decide that we would like to use your personally identifiable information in a manner that is materially less protective of your privacy than the Privacy Policy in effect at the time we received your personally identifiable information, we will seek to provide users notice and obtain consent to the new use or disclosure. Privacy Policy changes will be indicated by a change to the effective date at the end of the policy.
