At Omeros Corporation (“Omeros”, “we”, “us”, or “our”), your privacy is of the utmost importance. This supplemental Health Privacy Policy applies to information we collect on our website(s) (including www.omeros.com and other sites operated by Omeros (“Websites”) and from other sources, including information collected through offline interactions, and sets out how we collect, use, process, store, share, and disclose “Consumer Health Data” as such term is defined by applicable laws including Washington’s My Health My Data Act, Nevada’s Consumer Health Data Privacy Law, Connecticut’s Data Privacy Act, and other U.S. health privacy laws, as each are amended and as and when they become effective including any regulations thereunder (collectively “Consumer Health Data Privacy Laws”)

The Categories of Sources from Which We Collect Consumer Health Data
We may collect Consumer Health Data from the following sources:
- Directly from you, for example, when you contact us via email, mail, or our Websites;
- Authorized/legal representatives, family members, and caregivers;
- Health insurance companies (health plans) and other payors;
- Healthcare professionals that oversee the clinical trials (“Investigators”) that we sponsor, and you participate in as a “Clinical Trial Participant”;
- Healthcare providers authorized/legal representatives, family members, and caregivers that apply for patients to participate in our expanded access program;
- Healthcare providers, health insurance companies (health plans), and other payors that apply for patients to participate in our Patient Assistance Programs; and
- Advertising partners who provide digital marketing and analytics services for us using cookies, web beacons, pixels, and similar technologies placed on our Websites that contain a unique identifier.
The Categories of Consumer Health Data We Collect
Clinical Trial Participant Consumer Health Data:
When Investigators oversee clinical trials, they may provide Omeros with various types of Consumer Health Data about Clinical Trial Participants subject to the terms of Clinical Trial Participants signed informed consent and authorization. Below, we provide a list of the commonly processed Consumer Health Data associated with Clinical Trial Participants. Please note, the below list is not an exhaustive list and is intended to serve as a sample set.
- Clinical Trial Participant’s self-reported data such as country of residence, age or date of birth, sex at birth, race, demographic data, pregnancy status of Clinical Trial Participant or Clinical Trial Participant’s partner;
- Pseudonymous identifier; and
- The Clinical Trial Participant’s health prior, during, and after the clinical trial for the purposes of analyzing the Clinical Trial Participant’s health conditions and reaction(s) to certain therapeutics, including but not limited to: (i) health conditions, treatment, diseases, or diagnosis; (ii) social, psychological, behavioral, and medical interventions; (iii) health-related surgeries or procedures; (iv) use or purchase of prescribed medication; (v) bodily functions, vital signs, symptoms, or measurements of health information; and (vi) diagnoses or diagnostic testing, treatment, or medication.
Expanded Access and Patient Assistance Programs:
When patients, healthcare providers, or their caregivers apply for and/or participate in our expanded access and patient assistance programs, we may collect the following information about patients:
- For our expanded access program, we may collect the Patient’s contact information provided by the patient, caregiver, or the Healthcare Provider including pseudonymous identifier, and month and year of patient’s birthday.
- For our Patient Assistance Programs, we may collect the Patient’s contact information provided by the patient, caregiver, or the Healthcare Provider including name, date of birth, address, phone number, email address, household income, number of members in the household, whether the patient has insurance and what kind.
- For both the expanded access program and the Patient Assistance Programs, we may collect the patient’s medical history and other health information, including but not limited to: (i) health conditions, treatment, diseases, or diagnosis; (ii) social, psychological, behavioral, and medical interventions; (iii) health-related surgeries or procedures; (iv) use or purchase of prescribed medication; (v) bodily functions, vital signs, symptoms, or measurements of health information; and (vi) diagnoses or diagnostic testing, treatment, or medication.
Website(s) Visitors:
- Information when you reach out to us or request, we contact you, such as name, email address, and the contents of your communication to us; and
- Metadata and analytics when you visit our Websites, including IP address, device information, date/time of visits, new or returning visits, products viewed, page response times, URL clickstreams, how long you stay on our pages, what you do on those pages.
How We Use Consumer Health Data
We may use Consumer Health Data for the following purposes:
- To operate and improve our Websites. If you use our Websites, we use the personal information to:
- operate, maintain, administer and improve the Websites,
- better understand your needs and interests, and personalize your experience with the Websites,
- provide support and maintenance for the Websites, and
- respond to your requests, questions, and feedback.
- To operate and improve our clinical trials, research, studies, and product-improvement activities. We may use your personal information when necessary to facilitate our clinical trials, research, studies, and related activities that support product improvement, including to:
- recruit Investigators,
- track and respond to safety and product quality concerns (including product recalls),
- develop our therapeutics, and
- facilitate medication adherence programs;
- To operate and improve our expanded access program and patient assistance programs;
- define and manage appropriate patient engagement activities, and patient support programs (including to provide co-pay and other financial assistance where available), and
- facilitate medication adherence programs;
- To process payments securely;
- For support;
- To communicate with you, including via newsletter;
- For other business and legal purposes, such as to detect and prevent fraud, to collect amounts owing to us, and to maintain business records;
- For any legal purpose necessary, including intellectual property protection, or if Omeros is required to process information as a result of a court order or other legal or regulatory requirement or proceeding; and
- With your consent.
The Categories of Recipients of Consumer Health Data We Disclose & the Recipients
We may disclose the categories of Consumer Health Data described above with your consent. We may also disclose the categories of Consumer Health Data described above with:
- Our Corporate Affiliates. We may disclose Consumer Health Data with Omeros Ireland Limited, Omeros London Limited and any other entity controlled by or under common control of Omeros Corporation (our “Affiliates”).
- Service Providers. We may disclose your Consumer Health Data with service providers that perform certain functions on our behalf such as Websites hosting, database management, provide patient assistance programs, customer support, and communications vendors such as email service providers.
- With Third-Party Cookies Providers. Like many companies, we use cookies and similar technologies (such as clear gifs, web beacons, tags, and similar technologies) to collect information about your browsing activities and interactions with our Websites, to serve tailored ads, and for the purposes described in this Health Privacy Policy.
- FDA and Prescribing Healthcare Providers. If you contact Omeros regarding your experience with one of our therapeutics, we may use the information you provide in submitting reports to regulatory agencies, such as the U.S. Food and Drug Administration (“FDA”), and as otherwise required of us by law. We also may use the information to contact the prescribing healthcare provider to follow up regarding an event involving the use of our products.
We may disclose information in order to:
- Protect the legal rights of our company, our employees, our agents, and our Affiliates;
- Protect individuals’ safety and security;
- Detect and protect against fraud;
- Comply with law, regulations, or legal process; and
- Complete a legal transaction related to the sale of our business or any assets.
Your Consumer Health Data Rights & How to Exercise Them
Your Consumer Health Data Rights:
Depending on your state of residency you may have the following rights concerning your Consumer Health Data:
- The right to know if we are collecting, using, or disclosing your Consumer Health Data, to access that Consumer Health Data, including receiving a list of the entities and affiliates with whom we have shared or sold your information;
- The right to delete your Consumer Health Data;
- If we are processing your Consumer Health Data with your consent, you have the right to withdraw that consent; and
- The right to appeal our denial of a request.

If you are a Clinical Trial Participant, please contact the Investigator on your relevant study. Otherwise, you can exercise your Consumer Health Data rights through the following methods:

If, after we have processed your appeal, you are still unsatisfied with our response, you may have the right to file a complaint with your state attorney general, including:
